            Robert A. (“Rob”) Wimbish is Senior Counsel at Baker & Miller, specializing in all facets of surface transportation law, with a particular emphasis on railroads and trucking companies.  He represents clients before federal agencies, including the Surface Transportation Board (“STB”) and the Department of Transportation (“DOT”), and before federal appellate and district courts.

 

            Born and raised in Southern California, Mr. Wimbish obtained his undergraduate and law degrees from Georgetown University (BA, magna cum laude, 1990; JD, with distinction in the fields of administrative law and bankruptcy and creditor’s rights, 1993).  Since obtaining his license to practice law in 1993, Mr. Wimbish has been happily immersed in the field of transportation.

 

            From 1993 through 1999, Mr. Wimbish was an associate at the law firm of Rea, Cross & Auchincloss, where his practice ranged from non-transportation related litigation before the District of Columbia and Virginia courts to representing medium-sized and small railroads, shippers, and state and local entities in matters before the STB and the Federal Railroad Administration.  Among his many transportation projects, Mr. Wimbish advised clients in connection with major railroad consolidation proceedings before the STB, and he also assisted railroads and shippers in line sales and abandonments, rate and service disputes, contract negotiations, and rail equipment financing.

 

            From 2000 through 2002, Mr. Wimbish served as a senior associate at the law firm of Harkins Cunningham, where, among other tasks, he represented a Class I railroad in both major and minor merger proceedings before the STB, advised railroads on major regulatory policy issues, assisted a Midwestern electricity generating cooperative in seeking STB permission to construct a rail line to obtain competitive rail access for transportation of coal, and participated in non-transportation-related, multi-party litigation.

 

            From 2003 through August of 2006, Mr. Wimbish served as a staff attorney at the STB, where he advised the Board on such matters as the handling of rate disputes, Amtrak, flatcar pooling among railroads, service and interchange disputes, and questions concerning the scope of the Board’s jurisdiction over activities not traditionally considered as part of transportation (such as the operation of solid waste transfer facilities along rail lines).

 

            He is a member of the District of Columbia Bar, an associate member of the Virginia Bar, and a member of the Association of Transportation Law Professionals.
